The 287(g) program of the Immigration and Nationality Act) is a partnership initiative administered by U.S. Immigration and Customs Enforcement (ICE), under the Department of Homeland Security (DHS). It allows qualified state, local, and tribal law enforcement agencies to perform specific immigration enforcement functions under ICE's direction, supervision, and oversight.
The program aims to enhance public safety by identifying, processing, and removing removable noncitizens (often referred to as "criminal aliens" ) who are involved in crimes such as gang activity, violent offenses, human smuggling, organized crime, sex offenses, drug smuggling, or money laundering. It enables local agencies to assist ICE in immigration enforcement without shifting primary responsibility away from federal authorities.
Some benefits for participating agencies include reimbursements for equipment, vehicles, salaries, overtime, and potential eligibility for related federal funding like the State Criminal Alien Assistance Program (SCAAP).
Current Status (as of mid-January 2026)
The program has seen massive expansion since early 2025, driven by Executive Order 14159 ("Protecting the American People Against Invasion," issued January 20, 2025), which directs ICE to maximize 287(g) authorizations. Some states (e.g., Texas requires sheriffs in counties with jails to participate; others like Florida and Georgia have encouraged or mandated partnerships).
Active Agreements: As of January 16, 2026, ICE has signed 1,317 Memorandums of Agreement covering agencies in 40 states (including Minnesota).
